1 . Responsable del Tratamiento

El tratamiento de sus datos es responsabilidad de TELEFÓNICA AUDIOVISUAL DIGITAL, S.L.U. (en adelante TAD), empresa domiciliada en Avenida de los Artesanos, 6 - 28760 Tres Cantos – Madrid, con CIF B87613816, inscrita en el Registro Mercantil de Madrid al tomo 34.640, Folio 100, Sección 8, Hoja M - 623.179, Inscripción 1ª, lo que se indica a los efectos de dar cumplimiento a la Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico.

2. Motivación

TAD respeta los derechos de privacidad de sus Usuarios y reconoce la importancia de la protecciónde los datos personales que TAD recoge. El objetivo de este documento es informar a los Usuariossobre los tratamientos de datos personales que se realizan en este Servicio.

3. Datos personales tratados por el mero acceso al Servicio

3.1 Datos tratados y finalidad

Por el mero acceso al Servicio, TAD recoge la dirección IP y otros datos relativos a la conexión y su origen. La dirección IP es un código que identifica la conexión a internet del Usuario en un momento concreto. Solo el proveedor de acceso a internet del Usuario puede identificar al abonado que tenía asignada una dirección IP en un momento concreto. Por la propia naturaleza del servidor que da soporte al Servicio, la dirección IP del Usuario queda registrada automáticamente junto con la fecha y la hora del acceso.

3.2 Destinatarios de los datos

TAD no facilita esta información a ningún tercero, salvo que esté obligado a ello por la legislación vigente (por ejemplo, una solicitud oficial en el marco de una investigación policial).

3.3 Base jurídica que legitima el tratamiento

La base jurídica que legitima el tratamiento es su consentimiento al aceptar las condiciones del Servicio y acceder al mismo. La captación de la IP responde a la necesidad tecnológica para posibilitar la prestación del Servicio.

3.4 Plazo de tratamiento de los datos

Los datos serán mantenidos mientras utilice el Servicio. En caso de manifestar su voluntad de darse de baja del Servicio o retire su consentimiento sus datos serán mantenidos el tiempo necesario para responder a las responsabilidades legales que puedan haber surgido de su relación con TAD.

4. Otros tratamientos de datos personales

4.1 Cookies y similares

TAD utiliza cookies y otros mecanismos similares de almacenamiento y recuperación de datos en equipos terminales (en adelante, cookies).

Las cookies son ficheros que se descargan al navegador del Usuario y que pueden ser leídos posteriormente por la entidad. De esta forma, las cookies permiten diversas funcionalidades, como por ejemplo, reconocer a un Usuario que ya ha accedido a la Plataforma anteriormente y poder hacer análisis sobre el uso del servicio web que permitan mejorarlo

No obstante, no es posible averiguar la identidad del Usuario a partir de las cookies que utiliza la entidad, salvo que el Usuario proporcione información adicional a través de otros medios y estos pudiesen vincularse con las cookies que tiene descargadas.

4.2 Formulario de registro

TAD tratará los datos facilitados a través del formulario de registro, con la finalidad de gestionar el registro y acceso del usuario a la Plataforma.

TAD tratará únicamente la información personal estrictamente necesaria para identificar al Usuario y permitirle el acceso al Servicio, gestionar la relación que mantiene con TAD y el uso normal del Servicio.

La base jurídica que legitima el tratamiento es su consentimiento manifestado en el momento de solicitar el registro como usuario, a través de la marcación de la casilla establecida a tal efecto.

Los datos serán mantenidos mientras se mantenga activo el usuario. En caso de manifestar su voluntad de darse de baja del Servicio o retire su consentimiento, sus datos serán mantenidos el tiempo necesario para responder a las responsabilidades legales que puedan haber surgido de su relación con TAD.

TAD no facilitará esta información a ningún tercero, salvo que esté obligado a ello por la legislación vigente.

4.3 Tratamiento de datos de la documentación aportada por el usuario registrado

TAD tratará los datos facilitados por el usuario en la diferente documentación que proporcione en la plataforma, con la finalidad de cumplir con las obligaciones derivadas de la relación contractual, como consecuencia de las obligaciones y responsabilidades relativas a los supuestos de contratas y subcontratas establecidas en el artículo 42 del Estatuto de los Trabajadores. En este sentido, el usuario se compromete a cumplir con los principios de protección de datos establecidos en la normativa vigente, comunicando únicamente los datos necesarios relativos en la prestación del servicio.

En caso de que los datos proporcionados con estos fines incluyan datos especialmente protegidos, TAD tratará dichos datos basándose en la necesidad para el cumplimiento de una obligación legal y el ejercicio de los derechos del responsable en el ámbito del Derecho laboral y de la seguridad y protección social.

Los datos serán mantenidos mientras se mantenga vigente la relación contractual con TAD y posteriormente, durante el tiempo necesario para responder a las responsabilidades legales que puedan haber surgido de dicha relación.

TAD no facilitará esta información a ningún tercero, salvo que esté obligado a ello por la legislación vigente.

5. Derechos de los interesados

5.1 Qué derechos tiene el Usuario y cómo ejercerlos

La normativa de protección de datos garantiza a los Usuarios los siguientes derechos:

• Acceso: Permite al Usuario conocer qué información se tiene, de dónde se ha obtenido, a quién se ha facilitado y con qué usos se ha tratado.
• Rectificación: Permite al Usuario rectificar algún dato erróneo o desactualizado.
• Supresión: Permite al Usuario conseguir que se dejen de tratar sus datos.
• Oposición: Permite al Usuario conseguir que se dejen de utilizar sus datos con una finalidad concreta.
• Limitación: Permite al Usuario restringir el tratamiento de sus datos, pero de forma que sean conservados para alguna finalidad posterior.
• Portabilidad: Permite al Usuario obtener una copia de sus datos en formato electrónico y, en determinadas circunstancias, solicitar que sean comunicados a otro prestador de servicios. Sólo es aplicable para tratamientos informatizados realizados con el consentimiento del Usuario o para el cumplimiento de un contrato.
• Revocación del consentimiento: Permite al Usuario retirar el consentimiento que, en su caso, haya prestado para el tratamiento de sus datos.

El Usuario podrá ejercer sus derechos mediante comunicación escrita dirigida a la dirección de TAD anteriormente indicada o a través de un correo electrónico a la dirección movistarplus.RGPD@telefonica.com identificándose como USUARIO del Servicio y concretando su solicitud. Si los Usuarios consideran vulnerado su derecho a la protección de datos, podrán ponerse en contacto con la Agencia Española de Protección de Datos (www.aepd.es).

2. Motivation

TAD respects the privacy rights of its Users and recognizes the importance of protecting the personal data that the entity collects about its Users.

The purpose of this document is to inform the Users of the website about the processing of personal data carried out on this Service.

3. Personal data processed by the mere access to the Service

3.1 Data processed and purpose

By simply accessing the website, TAD collects the IP address and other data relating to the connection and its origin. The IP address is a code that identifies the User's Internet connection at a specific time. Only the User's Internet access provider can identify the subscriber who was assigned an IP address at a particular time. By the very nature of the server that supports the website, the User's IP address is automatically recorded along with the date and time of access.

3.2 Data recipients

TAD does not provide this information to any third party, unless required to do so by applicable law (e.g., an official request in the context of a police investigation).

3.3 Lawful professing

The legal basis that legitimizes the processing of the data is your consent by accepting the terms and conditions of the Service and accessing the same. The collection of IP addresses is technologically necessary to enable the provision of the Service.

3.4 Time limit for data processing

The data will be kept as long as you use the Service. In the event that you wish to unsubscribe from the Service or withdraw your consent, your data will be kept for the time necessary to respond to the legal responsibilities that may have arisen from your relationship with TAD.

4. Other processing of personal data

4.1 Cookies and similar technologies

TAD uses cookies and other similar mechanisms for storing and retrieving data on terminal equipment (hereinafter, cookies).

Cookies are files that are downloaded to the User's browser and can be read later by the entity. In this way, cookies allow various functionalities, such as, for example, recognizing a User who has previously accessed the website and being able to analyze the use of the web service in order to improve it.

However, it is not possible to find out the identity of the User from the cookies used by the entity, unless the User provides additional information through other means and these could be linked to the cookies downloaded.

4.2 Sign - in Form

TAD will process the data provided through the registration form, in order to manage the user's registration and access to the Plataform.

TAD will only process the personal information strictly necessary to identify the User and allow access to the Service, manage the relationship with TAD and the normal use of the Service.

The legal basis that legitimizes the treatment is your consent expressed at the time of applying for registration as a user, through the checkbox marked for this purpose.

The data will be kept as long as the user remains active. In the event that you wish to unsubscribe from the Service or withdraw your consent, your data will be kept for the time necessary to respond to the legal responsibilities that may have arisen from your relationship with TAD.

TAD will not provide this information to any third party, unless it is obliged to do so by current legislation.

4.3 Data processing of documentation provided by the registered user

TAD will process the data provided by the user in the different documentation provided on the platform, in order to comply with the obligations arising from the contractual relationship, as a result of the obligations and responsibilities relating to the cases of contracts and subcontracts established in article 42of the Workers' Statute. In this sense, the user undertakes to comply with the principles of data protection established in the regulations in force, communicating only the necessary data relating to the provision of the service.

In the event that the data provided for these purposes includes specially protected data, TAD will process such data on the basis of the need to comply with a legal obligation and the exercise of the rights of the responsible party in the field of labour law and safety and social protection.

The data will be kept as long as the contractual relationship with TAD remains in force and thereafter, for the time necessary to respond to the legal responsibilities that may have arisen from that relationship.

TAD wi ll not provide this information to any third party, unless it is obliged to do so by current legislation.

5. Data subjects' rights

5.1 What rights does the user have and how to exercise them

Data protection regulations guarantee Users the following rights:

• Access: Allows the User to know what information is held, from where it has been obtained, to whom it has been provided and with what uses it has been treated.
• Rectification: Allows the User to rectify any erroneous or outdated data.
• Suppression: Allows the User to stop the processing of his/her data.
• Opposition: Allows the User to stop the use of his/her data for a specific purpose.
• Limitation: Allows the user to restrict the processing of their data, but so that they are retained for a subsequent purpos e.
• Portability: Allows the User to obtain a copy of his/her data in electronic for matand, under certain circumstances, to request that they be communicated to another service provider. It is only applicable for computerized processing carried out with the consent of the User or for the fulfilment of a contract.
• Revocation of consent: Allows the User to withdraw the consent that, where appropriate, has been given for the processing of their data.

Users may exercise their rights by sending a written communication to the TAD address indicated above or by sending an e-mail to movistarplus.RGPD@telefonica.com identifying themselves as a User of the Service and specifying their request. If Users consider that their right to data protection has been violated, they may contact the Spanish Data Protection Agency (www.aepd.es).
